This Privacy Notice describes the information the QMeds, Inc. d/b/a QuiqMeds (“Adherent360”, “we”, “our”, or “us”) collects, how we use and retain this information, with whom we share it, and the choices you have in connection with these activities. This Privacy Notice applies to our health care professional cloud hosted software and mobile application software (collectively, the “Mobile App”).

For Patients: This Privacy Notice does not apply to you. Adherent360 may collect and store protected health information (as defined under the Health Insurance Portability and Accountability Act of 1996, as amended, and implementing regulations) on behalf of your healthcare provider as a business associate. As a business associate, Adherent360 cannot use or disclose protected health information in a way that your healthcare provider itself may not. For information on how your healthcare provider collects, uses, and shares your protected health information, please refer to your healthcare provider’s HIPAA Notice of Privacy Practices.

  1. PERSONAL INFORMATION WE COLLECT, HOW WE USE IT, AND HOW WE SHARE IT

When you interact with us through the Mobile App, we collect your personal information. Personal information is information that identifies, relates to, describes, is capable of being associated with, or could reasonably be linked, directly or indirectly, with a particular individual. 

We will collect your personal information as a health care provider, pharmacist, or other health care professional when you:

  • Register for Adherent360 Account. When you create an Adherent360 account, we will collect your identifiers (name, business email address, business telephone number), employment information and professional information (title, NPI (or pharmacist license), license number, license state; DEA number, suffix (if you provide it), expiration date, location(s); medical license number, state, and license type; for state PDMP account, username, password, state, and for PDMP automated reporting exemption – state). This information will be used to verify you and create your account and allow to you access your electronic medical record system, verify prescriptions, maintain inventory, and receive patient copayments.
  • Videoconference. When you use the videoconference functionality in the Mobile App, we collect your auditory and visual information (the sound of your voice and your appearance) through our third-party videoconference service provider. Videoconferences are not recorded. We use this information to facilitate your video consultation with the patient. 
  • Access the Mobile App. When you process a prescription through the Mobile App, your identifiers and employment and professional information (defined above) are share with our third-party providers for electronic prescription transfer and pharmacy claims processing, and your EMR provider. In addition to the personal information identified above, when you use the Mobile App, we and our third-party provider collect your internet and other electronic network activity (IP Address, internet service provider, unique identifier (UDID), browser type and version etc.) via trackers such as SDKs make the Mobile App work as you expect it to and to provide enhanced functionality and analytics as described below.  Some of the SDKs we use will store and retrieve information on your device, like a cookie or other similar tracker would.  
    • Essential SDKs.  We use essential SDKs which are necessary for the Mobile App to function. If you do not provide this information, we would not be able to provide the Mobile App. 
    • Performance SDKs.  When you use the Mobile App, we automatically collect, through our third-party SDK provider, your internet and other electronic network activity (IP Address, internet service provider, browser type and version etc.) regarding your device and use of the Mobile App. The Mobile App provider uses the information to test the performance of and improve the application for all users. 

You can stop all collection of information via an app by uninstalling the Mobile App. You can also reset your device at any time through your device settings, which may allow you to limit the use of information collected about you. 

Data Retention

Unless otherwise stated in this Privacy Notice, we retain your personal information (i) for as long as the relevant account exists, or (ii) until we no longer need your information to fulfill the purposes for which we collected it. However, we may need to use and retain your personal information for longer than the periods indicated above for purposes of: 

  • Compliance with our legal obligations. For example, retaining your records for the purpose of accounting, dispute resolution, and compliance with licensing, health care, labor, tax, licensing, and financial laws and regulations.
  • Meeting our safety and security commitments. Such as keeping our technologies secure and preventing fraud.
  • Exercising or defending legal claims. We also may need to retain personal information for longer than the periods indicated above in order to respond to legal process or enforceable governmental requests, or to enforce our contracts or Terms of Use, including investigation of potential violations.
  1. HOW WE SHARE YOUR PERSONAL INFORMATION 

Adherent360 shares personal information in the following instances: 

  • Within Adherent360. We share your personal information within Adherent360 to provide efficiently and effectively the Mobile App. Access to your personal information is limited to those on a need-to-know basis. 
  • With service providers. We share personal information with service providers that assist us in providing the Mobile App or our services. These service providers are described more specifically in the PERSONAL INFORMATION WE COLLECT, HOW WE USE IT, AND HOW WE SHARE IT section of this Privacy Notice. Generally, the Adherent360 may share relevant personal information with third-party vendors such as prescription fulfillment providers for electronic prescribing, pharmacy claims processing, covered entity EHR systems, and videoconference provider.
  • In the event of a corporate reorganization. In the event that we intend to alter, or do alters the structure of our business, such as a reorganization, we would share personal information with third parties and their agents and advisors for the purpose of facilitating and completing the restructuring. We would also share personal information with third parties if we undergo bankruptcy or liquidation, in the course of such proceedings. 
  • For legal purposes. We will share your personal information where we are legally required to do so, such as in response to court orders, law enforcement or legal process, including for national security purposes; to establish, protect, or exercise our legal rights, as required to enforce our terms of service or other contracts; to defend against legal claims or demands; to detect, investigate, prevent, or take action against illegal activities, fraud, or situations involving potential threats to the rights, property, or personal safety of any person; or to comply with the requirements of any applicable law to which Adherent360 is subject.
  • With your consent. Apart from the reasons identified above, we may request your permission to share your personal information for a specific purpose. We will notify you and request consent before you provide the personal information or before the personal information you have already provided is shared for such purpose. You may revoke your consent at any time.

Adherent360 may also share anonymized and aggregated data (“De-Identified Information”) in marketing materials.  

  1. DO NOT TRACK

We do not recognize “Do Not Track” requests for internet browsers. Do Not Track is a preference you can set to inform websites and applications that you do not want to be tracked.

  1. SECURITY OF YOUR PERSONAL INFORMATION

We implement and maintain reasonable security measures to protect the personal information we collect and maintain from unauthorized access, destruction, use, modification, or disclosure. These security measures include access controls and encryption. However, no security measure or modality of data transmission over the Internet is 100% secure and we are unable to guarantee the absolute security of the personal information we have collected from you.  

  1. AGE RESTRICTION

The Mobile App are not intended for individuals under the age of eighteen (18). If we learn that we have collected or received personal information from a child under the age of eighteen (18), we will delete that information. If you believe we might have information from or about a child under the age of eighteen (18), please contact us at info@adherent360.com.

  1. CHANGES TO THIS PRIVACY NOTICE

We may amend this Privacy Notice in our sole discretion at any time. If we do, we will post the changes to this page, and will indicate the date the changes go into effect. We encourage you to review our Privacy Notice to stay informed. If we make changes that materially affect your privacy rights, we will notify you by prominent posting on the Mobile App, and/or via email, and request your consent, if required.
